Resolution Establishing Suspension Policy and Procedure 

Purpose

This Resolution shall establish the authority and procedures to be followed to suspend for cause any person, including but not limited to, a member of the Knights of Columbus (herein also referred to as a "Knight"), or a family member of a Knight, guest, visitor, or organization from access to or use of facilities and property owned by the Columbus Club of Arlington, Inc. (herein also referred to as the "Corporation").

Cause

The causes for which a person may be suspended from access to the facilities and grounds of the Corporation shall include, but are not limited to, serious or repetitive misconduct, repetitive conduct unbecoming a Knight, criminal conduct, or a violation of the rules of conduct for the Main Hall, the Council Home or the pool snack bar.

Scope

This policy shall apply to any employee, officer or director, as well as any member, of the Columbus Club of Arlington, Inc., regardless of their membership standing. This policy shall also apply to any visitor, guest or organization of a Knight or the Corporation. The scope of this policy is limited to the access and use of the facilities owned by the Corporation, but shall not affect any right or privilege of a member Knight that is afforded by the Supreme Council of the Knights of Columbus.

Procedure for Short-Term Suspensions

It shall be the policy that the following employees of the Columbus Club of Arlington, Inc., shall have the authority to suspend persons and organizations from access to and use of the Corporation's property and facilities as follows: The Club Manager and Bartenders or ABC Managers on Duty (paid or unpaid) may suspend any person for a 24-hour period and such suspension may be issued verbally. The issuance of any short term suspension shall be reported, along with the basis for the suspension, in writing, to the Club Manager and the Board of Directors as soon as is practicable, but no later than noon of the next business day following issuance of the suspension.

Procedure for Long-Term Suspensions

It is recognized that a long-term suspension may be appropriate in situations involving serious or repetitive misconduct or criminal activity. A long-term suspension may be proposed without a previous short-term suspension or proposed after a person or organization has been subject to a short-term suspension. The suspension of any person or organization for a period of time in excess of one day shall be conducted in accordance with the following procedures:

1) Any complaint regarding behavior possibly warranting the suspension of any person shall be directed to the President of the Corporation.

2) The President of the Corporation shall immediately refer the matter to the Management Committee of the Board of Directors with any special conditions such as additions to or the recusal of any member of the Management Committee.

3) The Management Committee shall conduct an investigation of the basis of the complaint and shall question and hear witnesses and consider evidence related to the complaint and proposed suspension. The Management Committee shall endeavor to consider all information and evidence that may be offered; however, it is not obliged to consider any information or evidence that is frivolous and unrelated to the proposed suspension or intended to prolong or obstruct action by the Management Committee.

4) The person or organization against whom the complaint is made shall have the opportunity to present evidence to the Management Committee.

5) After the completion of the investigation, the Management Committee shall make a report and recommendation to the entire Board of Directors as to whether and for how long to suspend the person or the organization.

6) Upon presentation of the Management Committee's report and a recommendation of suspension, the Board of Directors shall meet in Executive Session and each director shall be afforded the opportunity to discuss their interpretation of the information presented to the Board in the Management Committee's report. The President of the Corporation shall then call the proposed suspension and the period of suspension to a vote of the members present at any meeting of the Board of Directors at which a quorum of the Board is present. A simple majority of the vote shall decide the suspension.

7) In the event the Board of Directors does not vote to suspend the person or organization, the President of the Columbus Club shall notify them verbally of the decision.

8) In the event the Board votes to suspend, the President of the Columbus Club shall issue written notice to the person or organization of the decision to suspend and the expiration date of such suspension. Such notice shall be presented in person or via receipted courier (e.g., Certified Mail, FedEx overnight delivery, etc.).
